Terms and Conditions
These Terms govern your use of raulincadet.com. Please read them carefully. They are available in French and in English, and both versions have the same value.
1. About these Terms
These Terms and Conditions (the "Terms") apply to raulincadet.com and its pages, including the Insights, the publications, the dashboards and the account features (together, the "site"). By browsing the site, you agree to these Terms. When you create an account, you are asked to accept them expressly. If you do not agree with them, please do not use the site.
The Privacy Policy explains how personal information is handled. It forms part of these Terms.
2. Who operates the site
The site is operated by Raulin L. Cadet ("we", "us", "our"). You can reach us at contact@raulincadet.com.
3. Eligibility and accounts
- You must be at least 18 years old, or the age of majority where you live, to create an account.
- You sign in with a LinkedIn, Google, Microsoft or GitHub account. You are responsible for keeping that account secure and for activity carried out through it on the site. Tell us without delay if you believe your account has been used without your permission.
- You may hold only one account, and only for yourself. You may not create an account by automated means or under a false identity.
- You can update or delete your account at any time on the "My account" page.
4. Content and intellectual property
Unless otherwise indicated, the texts, analyses, dashboards, charts, datasets compiled by us, software, design and other content of the site (the "content") belong to us or to their respective owners and are protected by copyright and other intellectual property laws.
- You may view the content and print or download reasonable extracts for your personal, educational or research use, provided that you cite the source (author, title, raulincadet.com and date) and do not alter it in a misleading way.
- Any other use, in particular commercial use, republication, systematic reproduction or the creation of a competing service, requires our prior written permission.
- Publications may also be subject to the rights of their publishers or co-authors. Copies made available on the site are provided for personal and scholarly use within the limits allowed by those rights.
- Your rights under the Copyright Act (Canada), including fair dealing for research, private study, education, criticism, review and news reporting, are not affected.
5. Dashboards, data and estimates
- The dashboards, indicators and salary estimator are built from job postings published by third parties and from statistical methods. The data may be incomplete, out of date or contain errors, and the methods have limits that are described on the site.
- Results are statistical estimates for general information only. They are not an offer of employment, a promise of salary, or financial, legal, tax, human resources or career advice, and they are not a substitute for advice from a qualified professional.
- You must not use them as the sole basis for a decision about a specific person, such as a hiring, pay or employment decision.
- You remain responsible for the decisions you make based on the site.
6. Insights and professional services
The Insights and other publications express the views of their author at the time of writing. They do not necessarily reflect the views of any institution with which the author is or has been affiliated. Reading the site or contacting us does not create a client, consulting or professional relationship. Any consulting, teaching or research engagement is governed by a separate written agreement.
7. Acceptable use
You agree to use the site lawfully and in good faith. In particular, you must not:
- access, collect or copy the site or its content by automated means (robots, scrapers, crawlers or scripts), except as permitted for public search engines, or use the content to train or improve artificial intelligence or machine learning models, without our prior written permission;
- overload the site, bypass usage limits, or use the estimator or other features in a way that is abusive or that aims to extract the underlying data or models;
- attempt to gain unauthorized access to the site, to other accounts or to our systems, test their vulnerabilities, or bypass security measures;
- introduce viruses, malicious code or any harmful mechanism;
- impersonate another person, misrepresent your identity or affiliation, or collect information about other users;
- send spam or unsolicited advertising, or use the site for commercial solicitation;
- publish content that is unlawful, defamatory, discriminatory, harassing, threatening, obscene, or that infringes the rights of others, including their privacy or intellectual property;
- remove copyright notices or other proprietary notices from the content.
If you discover a security vulnerability, please report it to us in confidence at contact@raulincadet.com and do not exploit it.
8. Comments
- Comments are public and are displayed with your name. Do not include personal or confidential information in them, whether about yourself or others.
- You keep the rights to your comments. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display and format them on the site and in its archives for as long as they are published, and to make the minor technical adaptations needed for display.
- You confirm that you have the right to publish your comments and that they comply with these Terms and the law. You are responsible for them.
- We may moderate, hide or remove any comment that does not comply with these Terms or the law, or that is off-topic, without being obliged to monitor comments.
9. Feedback
If you send us suggestions or ideas about the site, we may use them freely to improve it, without obligation to you. This does not apply to personal information, which remains governed by the Privacy Policy.
10. Third-party services and links
The site uses or links to services run by third parties, such as sign-in providers (LinkedIn, Google, Microsoft, GitHub), citation badges, publishers' websites and audience measurement. Those services are governed by their own terms and policies. We do not control them and are not responsible for their content, availability or practices. A link does not mean that we endorse a site.
Some links to books are affiliate links: as an Amazon Associate, we earn from qualifying purchases, at no extra cost to you. The books presented have been read by the author, and their descriptions express his personal opinion. Prices, availability and sales are handled by Amazon under its own terms.
11. Copyright complaints
If you believe that content on the site infringes your copyright, write to us at contact@raulincadet.com. Identify the work, the content concerned and its location, and give your contact information and a statement that you hold the rights or act on behalf of the holder. We will review the complaint promptly and take appropriate measures.
12. Privacy
Our handling of personal information is described in the Privacy Policy, which complies with Quebec's Act respecting the protection of personal information in the private sector and Canada's Personal Information Protection and Electronic Documents Act.
13. Availability and changes to the site
We aim to keep the site available and accurate, but we do not guarantee that it will be uninterrupted, free of errors or always up to date. We may correct, change, suspend or discontinue all or part of the site, in particular for maintenance, security or legal reasons. When reasonably possible, we will give notice of a change that significantly affects account holders.
14. Suspension and termination
You may stop using the site and delete your account at any time. We may suspend or close an account, or limit access to the site, if you seriously or repeatedly breach these Terms, if required by law, or to protect the site, its users or third parties. Except in urgent cases or where the law prevents it, we will tell you the reason. The sections that by their nature should survive termination, such as sections 4, 15, 16, 17 and 19, remain in effect.
15. Disclaimer
To the extent permitted by law, the site and its content are provided "as is" and "as available", without warranty of any kind, express or implied, including as to accuracy, completeness, fitness for a particular purpose or non-infringement. Nothing in these Terms excludes or limits the warranties or rights that you have under laws that cannot be excluded by contract, in particular the Civil Code of Québec and the Quebec Consumer Protection Act.
16. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, loss of profits, revenue, opportunities or data, resulting from the use of, or the inability to use, the site or its content, including decisions made based on the dashboards or estimates. The site is provided free of charge. To the extent permitted by law, our total liability for any claim relating to the site is limited to CAD 100.
These limitations do not apply to damages resulting from our intentional or gross fault, or to bodily or moral injury caused to a person, for which liability cannot be excluded or limited (article 1474 of the Civil Code of Québec). They do not affect the rights of consumers that cannot be waived under the Quebec Consumer Protection Act or other applicable laws.
17. Responsibility for your conduct
To the extent permitted by law, you are responsible for, and agree to compensate us for, the damages and reasonable costs, including legal fees, resulting from a claim by a third party caused by your intentional or unlawful use of the site, by your comments, or by your serious breach of these Terms.
18. Changes to these Terms
We may update these Terms, for example when the site or the law changes. The effective date at the top shows when they last changed. If a change significantly affects account holders, we will inform them in advance, by a notice on the site or by email, and may ask them to accept the new Terms. If you do not agree with the new Terms, you may delete your account at any time. Changes do not apply retroactively.
19. Governing law and disputes
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. Any dispute falls under the jurisdiction of the competent courts of the Province of Quebec, subject to the right of consumers to bring proceedings before the courts of their domicile under the law.
Before going to court, we invite you to contact us so that we can try to resolve the matter amicably. There is no mandatory arbitration, and nothing in these Terms limits your right to take part in a class action.
20. General provisions
- Language. These Terms are available in French and in English, and both versions have the same value. You can read the French version before accepting them.
- Electronic communications. You agree that notices and communications relating to the site may be given to you electronically, on the site or by email.
- Entire agreement. These Terms and the Privacy Policy form the entire agreement between you and us regarding the site.
- Severability. If a provision is found to be invalid or unenforceable, it is limited to the minimum extent necessary and the other provisions remain in effect.
- No waiver. Not exercising a right is not a waiver of it.
- Transfer. We may transfer these Terms to a person who takes over the operation of the site, provided that your rights are not reduced. We will inform account holders of such a transfer.
- Superior force. We are not liable for a failure or delay caused by an event beyond our reasonable control (superior force).
